საქართველოს სამოქალაქო კოდექსის 678-ე მუხლის მე-2 პუნქტის თანახმად, გამგზავნი პასუხს აგებს გადამზიდველის წინაშე ტვირთის უხარისხო შეფუთვით გამოწვეული ზიანისათვის, რომელიც მიადგა პირებს, მასალებსა და სხვა ქონებას, ასევე უხარისხო შეფუთვით გამოწვეული ხარჯებისათვის, გარდა იმ შემთხვევებისა, როცა ნაკლი აშკარა იყო, ან ტვირთის მიღებისას გადამზიდველმა ამის შესახებ იცოდა და ამასთან დაკავშირებით რაიმე პირობა არ დაუთქვამს.
